SMS Privacy Policy

By “Opting In” to or using a “Text Message Service” (as defined below) from Applied Engineering, Inc., you accept these Text Messaging / SMS Terms of Use (“Terms of Use” or “Agreement”). This Agreement is between you and Applied Engineering, Inc. (“us,” “we,” “our”). THIS AGREEMENT IS SUBJECT TO A WAIVER OF CLASS ACTION RIGHTS AS DETAILED BELOW.

  1. Definitions
    “Opting In,” “Opt In,” and “Opt‑In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

    “Text Message Service” includes any arrangement or situation in which we send one or more messages to your mobile phone number, including text messages.

  2. We may send you text or SMS messages to notify you of any updates to your application status and to engage in discussion throughout your application or employment process.

  3. By consenting to receive text messages from us, you agree to these Terms of Use, as well as our Privacy Policy, incorporated herein by reference. By Opting In to receive our text messages, you agree that we or our agents may use any automated or non‑automated technology to send you promotional and/or informational text messages

  4. You can cancel the Text Message Service at any time. Just text “STOP” to unsubscribe. After you send the text / SMS message “STOP” to us, we may send you a text / SMS message to confirm that you have been unsubscribed. After this, you will no longer receive text / SMS messages from us.

  5. If you are experiencing issues with the messaging program you can reply with the keyword “HELP” for more assistance, or you can get help directly at marketing@go-applied.com.

  6. The Text Message Service is provided on an “as‑is” and “as available” basis and may not always be accessible in all locations. Its functionality may be affected by changes in products, software, coverage, or other factors imposed by your wireless carrier. We are not responsible for any delays or failures in receiving mobile messages associated with this Text Message Service. The delivery of mobile messages depends on effective transmission from your wireless service provider or network operator, which is beyond our control.

  7. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

  8. READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS. The laws of the state of Minnesota, without regard to principles of conflict of laws, will govern these Terms of Use and apply to any disputes or claims arising out of or relating to any Text Message Service or these Terms of Use. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use shall be instituted exclusively in the federal courts of the United States or the courts of the State of Minnesota, in each case located in the City of Minneapolis, although we retain the right to bring any suit, action, or proceeding against you in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. You agree that any litigation or other proceeding against shall be conducted in your individual capacity only and not as a class action or other representative action, and you expressly waive your right to file a class action or seek relief on a class basis. YOU AGREE THAT YOU MAY BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

  9. If you plan to stop using the mobile number associated with the Text Message Service‑whether by canceling your service or transferring the number‑you agree to cancel your Text Message Service before discontinuing use of that number. You acknowledge that this obligation is a significant part of these Terms of Use. If you fail to notify us of any changes to your mobile number, you will be responsible for any costs (including legal fees) and liabilities incurred by us or any party assisting in delivering mobile messages due to claims from individuals who later acquire that number. This obligation will remain in effect even after you cancel your participation in the Text Message Service. You agree to indemnify, defend, and hold us harmless from any claims or liabilities arising from your failure to inform us of changes to your provided information, including any claims under the Telephone Consumer Protection Act, 47 U.S.C. § 227, et seq., or similar laws relating to or resulting from our attempts to contact you at the mobile number you provided.
